Ofgem Proposes Fees to Curb Speculative Data Centers

Britain’s energy regulator, Ofgem, announced on Wednesday a consultation on a proposed commitment fee aimed at reducing speculative applications from data center projects that are congesting the electricity grid. The new Data Centre Commitment Fee would require large data center developers to pay a fee ranging from £237,500 to £712,500 per megawatt (MW) when accepting a connection offer. This fee would be refundable once the project reaches grid connection status but forfeited if the project exits the grid queue prematurely, according to Ofgem.

The regulator's proposal comes in response to a dramatic increase in connection applications, which surged from 41 gigawatts (GW) to 125 GW between November 2024 and June 2025. Ofgem noted that data centers accounted for at least 73 GW of this pipeline across 315 projects, raising concerns that speculative schemes were blocking viable developments from securing necessary grid capacity.

Background

The rise in applications has been largely driven by the demand for AI infrastructure, with over 60 planning applications for new data centers submitted across England and Wales in 2025, a 63% increase from the previous year. The boom has attracted developers hoping to capitalize on rising land values, leading to speculation that many sites marketed as future AI campuses lack the necessary fundamentals to become operational.
